Acceptance of terms

This Agreement (“Agreement”) between Delchain Limited and its subsidiaries (“Delchain”) and you (“you” or “yours” or “user”) governs your use of the websites, and any page thereof, owned and/or operated by Delchain (the “Websites”).  Please read these terms and conditions carefully.  The issuer of the content of this website is Delchain, which is licensed in the Commonwealth of The Bahamas as an information technology service provider.  By accessing, visiting or using the Websites, you acknowledge, understand and agree with the following terms and conditions, and legal information relating to the use of the Websites.

The Content described on the Websites is for information purposes only and subject to change from time to time, as published herein.

The Content on this website has been compiled from sources that Delchain believes to be reliable. The user of the Websites is reminded that the confidentiality of e-mail messages sent via the public network cannot be guaranteed.  It is your own responsibility when forwarding personal data or other confidential messages to Delchain via e-mail.  Delchain shall be neither responsible nor liable for losses or damage incurred by any disappearance or transformation of such a message.  The information contained in messages from Delchain may be confidential or privileged and is only intended for the use of the individuals or entities to which it is addressed.  If you are not the intended recipient, you are requested by Delchain to delete the message (with attachments) without opening it and you are notified by Delchain that any use, disclosure, dissemination or reproduction of the information contained in the message (with attachments) is strictly prohibited and may be unlawful.

E-mails are susceptible to interference and Delchain cannot guarantee that the contents of any message received by you has not been intercepted or manipulated by third parties.

Personal data

All communication, electronic or otherwise, between the user and Delchain by means of the Websites, and all information, whether sensitive or otherwise, that the user provides or inputs during his/her use of the Websites, or which is collected through the Websites, may be subject to computer recording or otherwise, retention automated processing and used to include it in a database, marketing, monitoring and analysis of business, legal and regulatory compliance and/or for any other related business purpose by Delchain.

User of the Websites authorises Delchain to collect, store electronically or otherwise, make use of and process personal data obtained.  The user has the right to modify or delete these personal data when it is proven to be incorrect.  Delchain may store these personal data for the maximum period permitted under data protection laws and regulations.

The user expressly authorises Delchain to share the user’s data with companies within Delchain, except where, in doing so, Delchain would be acting in contravention of confidentiality rules to which it is subject.

Confidentiality

Any information or material sent to Delchain through the Websites will be handled in a manner consistent with legal and regulatory requirements.

Governing law and jurisdiction

Your access to, visit to and use of the Websites and this Agreement are governed by and shall be construed in accordance with the laws of the Commonwealth of The Bahamas.  The Courts of The Bahamas shall have exclusive jurisdiction over any dispute relating thereto.

Delchain may amend these terms and conditions at any time, with immediate effect and without prior notice.

Restricted access

This marketing document may contain material that is not directed to, or intended for distribution to or use by, any person or entity who is a citizen or resident of or located in any locality, state, country or other jurisdiction where such distribution, publication, availability or use would be contrary to law or regulation or which would subject Delchain Limited to any registration or licensing requirement within such jurisdiction.
